Terms of Service

Effective date: September 01, 2026

Heritage Leather & Hardware is operated by Heritage Leather & Hardware LLC, located at 9056 Long Point Road, Houston, Texas 77055. "Heritage," "we," "us," and "our" refer to Heritage Leather & Hardware LLC. "You" refers to the person using this site or placing an order. These Terms apply to your use of this website, to order requests you submit, and to orders you place.

Please read these Terms together with our Privacy Policy and our Shipping and Returns page, which are part of your agreement with us.

Order requests are not orders. Submitting an order request tells us what you are interested in and asks us to confirm availability, pricing, and total cost. It is not a purchase, it does not collect payment, and it does not create a binding agreement for either of us. We may confirm your request in whole or in part, propose changes, quote a different price, or decline it. You are free to change your mind or withdraw the request at any point before an order is placed and paid.

When an order becomes binding. A binding order is formed only when payment for that order has been successfully completed and confirmed by our payment processor. Until that confirmation is received, an order in progress, including one shown as pending, is not binding on either of us and may be changed, declined, or cancelled. Adding items to a cart, beginning checkout, or receiving an acknowledgement of an order request does not create a binding order.

Accepting these Terms. By submitting an order request, by placing an order, or by using this site, you agree to these Terms as they exist at that time. If you do not agree, please do not use the site or place an order.

Your information must be accurate. You agree to provide accurate and complete contact, billing, shipping, and recipient information, and to keep it current. We are not responsible for a delivery that fails or is delayed because the information provided to us was incorrect or incomplete. This matters especially for orders addressed to a correctional facility, where an incorrect name, identification number, facility, or unit will usually cause the package to be refused or returned.

Minimum age. To complete a paid order you must be at least 18 years old, or have the permission of a parent or legal guardian who accepts these Terms on your behalf. We do not verify age automatically, and we rely on you to tell us the truth about this.

Products, pricing, and availability. We work to describe our products accurately, but descriptions, images, specifications, and availability may contain errors or change without notice. Natural materials such as leather vary in color, texture, thickness, and marking from hide to hide and from lot to lot, and some variation from a photograph is normal and is not a defect.

Prices are shown in US dollars and may change at any time before a binding order is formed. If an item's price, availability, or description is materially wrong after you have placed an order, we will contact you to correct it, offer you the choice to proceed or cancel, or cancel the order and refund you in full.

We may refuse or cancel an order. We may decline or cancel any order, in whole or in part, including where an item is unavailable or discontinued, where a price or description was materially in error, where we suspect fraud or misuse, where we cannot ship to the destination, where an item is restricted at the destination facility, or where filling the order would violate a law or a facility's rules. If we cancel an order for which payment has already been collected, we will refund the amount collected for the cancelled portion to the original payment method.

Contact us as soon as possible if you need to cancel an order. We will honor a cancellation when reasonably possible before the order has shipped or before custom, made-to-order, cut-to-length, or specially procured work has begun. If payment has already been collected and the cancellation is approved, the refund will be issued to the original payment method. An order cannot be cancelled after shipment, but it may qualify for return under the Return Policy.

Returns, refunds, and items that cannot be returned. Our full return and refund terms, including the timeframes that apply and the condition an item must be in, are set out on our Shipping and Returns page and form part of these Terms.

Some items cannot be returned, unless they arrive defective, damaged, or are not what you ordered. These are: custom items, made-to-order items, specially procured items, altered items, cut-to-length items, and merchandise clearly marked as final sale. Because these are made, cut, or sourced specifically for your order, we cannot return them to stock. If you are unsure whether an item falls into one of these categories, ask us before you order and we will tell you.

Nothing in this section limits your rights if an item arrives damaged, defective, or incorrect. Those situations are always covered, whatever category the item falls into.

Orders addressed to a correctional facility remain subject to that facility's own mail, package, vendor, and property rules. Those rules are set and enforced by the facility, not by us. They change without notice to us, and they can differ between units. We cannot guarantee that a facility will accept any particular package, and we are not responsible for a facility's decision to refuse, hold, open, inspect, confiscate, or return an item.

Because of those same security requirements, we are not able to accept merchandise returned from an inmate address. Please confirm the recipient's name, identification number, facility, and unit, and confirm that the items are permitted at that facility, before you order. If you tell us before we ship that an item is not permitted at the destination, we will work with you to adjust or cancel that part of the order.

We do not provide an additional Heritage warranty on the products we sell. Where a product carries a manufacturer's warranty, that warranty passes through to you on the manufacturer's own terms, and we will help you identify the manufacturer and direct a claim to them. Apart from any such manufacturer warranty and the commitments we make in these Terms and on our Shipping and Returns page, products are sold as they are, without additional warranties from us, to the extent the law allows.

This section does not take away rights or remedies you have under the law that cannot be waived, and it does not limit our commitments to you if an item arrives damaged, defective, or incorrect. Where applicable law gives you a right that cannot be excluded, that right applies regardless of what this section says.

If something goes wrong with your order, our responsibility is to make it right under these Terms and our Shipping and Returns page, by repairing, replacing, or refunding as those terms provide.

Beyond that, and to the extent the law allows, we are not responsible for indirect or consequential losses arising from your use of the site or from a product, such as lost profits, lost time, or loss arising from a project you were unable to complete. Except where the law provides otherwise, our total liability relating to an order will not exceed the amount you paid us for that order.

This section does not limit our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot be limited under applicable law. It also does not override the refund, replacement, and cancellation commitments we make elsewhere in these Terms, which we will honor as written.

You agree to use this site only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access to it, or use it to place fraudulent orders. The content on this site, including our product descriptions, photography, and written guides, belongs to us or is used with permission, and may not be copied or used commercially without our permission.

If you create an account, you are responsible for the email address associated with it and for the activity that takes place through it. Because sign-in uses a one-time code sent to your email address, keeping that email account secure is what keeps your Heritage account secure. Tell us promptly if you believe someone else has gained access.

Governing law and venue. These Terms and any dispute arising out of them or out of an order are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. You and we agree that the state and federal courts located in Harris County, Texas will be the venue for any such dispute. If you are a consumer, this does not take away any right you have to bring a claim in another location where applicable law gives you that right.

We may update these Terms from time to time by posting a revised version with a new effective date. The version in effect when you place an order governs that order.

If any part of these Terms is found unenforceable, the rest continues to apply.
